- Rental Eligibility —All drivers must be twenty-five (25) years of age with current drivers license and carry automobile liability insurance. Additional drivers must be listed in the rental agreement.
- Reservations and Availability —Reservations will be confirmed via email. If the vehicle selected is unavailable a similar vehicle may be substituted.
- Rental Rates and Charges — Rental rates are seasonal and subject to change from time to time. Current pricing listed on the company’s website at the time of booking will be honored for each reservation. All rentals subject to sales tax @ 7%. All rentals require a credit card, and reservations require a 50% deposit or payment in full. All rentals require a two-day minimum. Pre-rental cart inspections are done prior to each rental and when carts are returned. Any damage to carts is the sole responsibility of the registered renter and repair costs will be charged to the registered renter. All carts have a range of roughly thirty-five to forty miles per charge (depending on speed and number of passengers). Renters are instructed to watch the cart’s battery charge gauge, and ensure that charge is sufficient for operation. Each rental cart includes a charging cable. A substantial retrieval fee will be charged for any cart that must be retrieved due to an uncharged battery. A lost charging cable will result in a replacement fee being charged to the registered renter. Lost cart keys or key cards will result in a replacement charge. A reasonable cleaning fee not to exceed $300 may be charged if a cart is returned substantially less clean than when rented.
- Payment Terms —All reservations require a valid credit card and a completed credit card authorization. Reservations require a deposit of 50% of the rental fee when booked more than 72 hours prior to delivery. Payment in full is due 72 hours prior to delivery. Any unpaid balance will be charged to the credit card on file prior to cart delivery. Any rental extension will be charged to the card on file prior to the extension of the rental.
- Cancellations and Refunds —Cancellations made more than 72 hours prior to the scheduled reservation date: The deposit is refundable, less any applicable cancellation fee.Cancellations made 72 hours or less prior to the scheduled reservation date: The deposit is non-refundable. At the sole discretion of Bay Coast Carts, the customer may receive a credit toward a future rental, subject to availability and any applicable restrictions.
Holidays and Special Event Dates: Deposits and payments for reservations occurring on holidays or designated “Special Event Dates” are non-refundable and are not eligible for rental credit.
- Rental Period and Late Returns —Carts will be delivered and picked up at the address given in the rental agreement. Delivery and pick-up times are given at the time of reservation. Any delay in either delivery or pick-up caused by the renter may result in additional fees or the forced 100% non-refundable cancellation of the rental.
- Delivery and Pickup —Renters must be available at the address given at the time of the scheduled delivery to receive the cart, and carts must be available at the place and time of pick-up agreed to in the rental reservation.We deliver to addresses in the following communities; Bay Saint Louis, Waveland, Pass Christian, Long Beach. We do not deliver to any areas outside of these communities.
- Authorized Use and Operating Area —Carts may only be operated on city streets with a speed limit of 25 MPH or less. Carts must obey all parking and traffic laws. Each coastal city has developed their own cart ordinance with instructions on where and how carts may be operated. Carts are NOT allowed to operate on any highway with the exception of crossing HWY 90, where allowed by law. Carts are NOT allowed on any beach or beach sidewalk and will be ticketed for doing so. All drivers on city streets must possess a valid driver’s license and proof of insurance. See attached information from each community’s cart ordinance and contact information for each Police Department.
- Safe Operation Rules — All drivers must follow traffic laws / city ordinances, obey passenger limits, use available safety equipment and avoid reckless or unsafe operation.
- Prohibited Uses — Driving under the influence of any substance or alcohol is strictly prohibited and illegal. Racing, towing, overloading, off-road use, unauthorized drivers or transporting the cart outside the approved area is prohibited. Any prohibited use of a cart is subject to additional fees and/or prosecution.
- Customer Responsibility for the Cart — The renter is responsible for protecting the golf cart, securing the keys, monitoring charging needs and returning it in the required condition.
- Damage, Loss and Theft — Carts are inspected at the time of delivery and pick-up. Renter is responsible for repair costs if any damage is found. Replacement fees will be incurred in the event of lost or damaged key cards / fobs, charger cables and extension cords.
- Accidents and Mechanical Problems — Any accidents, injuries, breakdowns or warning lights, require the renter to contact us immediately and cease use of the cart until instructed to do so. Any issue with the function of the cart must be reported immediately via phone. In the event of a cart malfunction due to no cause by renter, a replacement cart will be delivered if available.
- Insurance and Liability — All drivers must be listed on the rental agreement and all must have a current drivers license. All renters must have proof of liability insurance meeting the state minimums. Any damage incurred to the cart is the sole responsibility of the renter. Renters agree to hold harmless and indemnify Bay Coast Carts, the company’s employees and officers, from all claims, liability, costs resulting from the renters use of the vehicle. Any damages, injuries, deductibles or claims remain the renter’s responsibility.
- Weather and Emergency Policies — Sudden weather alerts are common on the coast. Heavy rain and winds can cause unsafe conditions on roadways and can cause damage to persons and property. Customers are advised to never drive through standing water as it may be dangerous. Forecasted rain is not grounds for automatic reservation cancellation. In the event of a “Named Storm” posing an imminent threat to the area, all reservations will be canceled and customers contacted. Should a “Named Storm” threat arise during a current rental, our team will contact the customer and make arrangements to pick up the cart and terminate the rental.
- Traffic Tickets and Violations —The renter is responsible for citations, towing charges, impound fees, parking violations and related administrative costs incurred during the rental. Any such violations or incidents must also be reported to Bay Coast Carts immediately.
- Cleaning and Condition Requirements — Replacement fees will be incurred in the event of lost or damaged key cards / fobs, charger cables and extension cords. A reasonable cleaning fee not to exceed $300 may be charged if a cart is returned substantially less clean than when rented. Renters are asked not to use harsh cleaning chemicals on any area of the cart. If a cart requires cleaning, simply use dish soap and water.
- Limitation of Liability —This is a contract for the rental of the vehicle. We may repossess the vehicle at the renter’s expense without notice if the vehicle is abandoned or used in violation of the law or this agreement. You agree to indemnify, defend, and hold Bay Coast Carts, Bay Coast Rentals LLC, harmless from all claims and Liability, costs, and attorney fees incurred resulting from, or arising out of, this rental and your use of the vehicle. Renter is responsible for any Damage or Loss incurred during the rental agreement. Renter is responsible for all loss, theft of, or damage to, the vehicle, which includes the cost of repair, or the actual cash value of the vehicle on the date of the loss if the vehicle is not repairable or if we elect not to repair the vehicle, plus loss of use, diminished value of the vehicle caused by damage or required repair, and our administrative expenses incurred in processing the claim. Renter must report all mechanical issues, accidents or incidents of theft and vandalism to us and the police immediately when discovered.
- Website and Booking-System Use —Unauthorized access and copying of the company’s content, logos, photographs or branding. All information contained in this site is proprietary in nature and the explicit intellectual property of the company. Fraudulent reservations or misuse of the website or any of its content may result in prosecution.
- Agreement to the Terms — By completing a reservation, signing the rental agreement or selecting an acceptance checkbox, each customer indicates agreement to the applicable terms and is responsible for payment accordingly. Mississippi law recognizes electronic records, electronic signatures and electronic contracts in qualifying transactions.
- Changes, Governing Law and Contact Information — Changes to this or any company document are date stamped. Mississippi is the governing state and holds jurisdiction in the case of any dispute. Contact Bay Coast Carts directly with any policy questions or disputes.
